It's only for players on the 40-Man Roster. Like last season when the Braves traded for Derrek Lee. The top prize for the Cubs was a top 20 prospect for the Braves in Robinson Lopez and he didn't go through waivers. If he did, who wouldn't claim him? Until players in the MLB they are not in the MLBPA and the rule above is for MLB players. This is also why in baseball video games the game company cannot put the real names of prospects who have not yet played in the majors.
