This sets a bad precedent that a bet can be paid when convenient rather than when the bet has been decided. If the bet needed to specifically have a conditional payout that should have been discussed at the time of the bet. Gilly knew this bet wasn't looking good in his favor since before the deadline. If he needed to make a move as insurance for this bet that was the time to do that; not simply plead ignorance now.
